Intel Corp. (INTC), largest chip manufacturer in the world, was charged with infringement of patents held by a company of Pennsylvania on ways to improve how power is delivered to an electronic circuit.
X2Y attenuators LLC, based in Erie, Pennsylvania, filed a complaint yesterday with the International Trade Commission of United States in Washington and a civil suit in his hometown. The complaint of the ICC seeks to block imports of Intel microprocessors, including its high range office computer Core i7 chip, and Apple Inc. (AAPL) and Hewlett-Packard Co. (HPQ) computers that are running on the processor.
"Apple and HP incorporate Intel microprocessors infringement, in their computers" X2Y said in the complaint of the ICC. "These microprocessors perform the core functionality of Apple and HP accused products."
The inventions covered by patents, five on the whole, are designed to overcome the electromagnetic interference that can damage electronics, according to the complaint of the ICC. X2Y said that he has obtained a license of his inventions for inclusion in satellite radio, military aircraft and for noise cancellation headphones.
X2Y said he "tried to persuade Intel based in Santa Clara, California for technology licensing of the X2Y for use in Intel microprocessors."
Microprocessors are made to the Costa Rica, the Malaysia, the Philippines and China, according to the complaint.
"We will assess the case," said Chuck Mulloy, an Intel spokesman. "We would expect that we will conduct a vigorous defence."
The civil suit, filed in Federal Court in Erie seeks compensation of cash not specified for the unauthorized use of the patents X2Y. The case is likely to be put on hold until the ICC review is completed.
The ITC is an independent body which investigates unfair trade practices, including patent infringement and has the power to block the import of products which that is found to violate U.S. patent rights. If she agrees to investigate the complaint of the X2Y, it will complete the process in 15 to 18 months.
